Devil's Due Issues Legal Statement
On June 25, 2004, the Dabel Brothers unilaterally issued a Press Release announcing their departure from Devil’s Due. While Devil’s Due Publishing did not wish to bring legal discussions into the public forum, the Press Release issued by Dabel Brothers makes a brief response necessary.
In October 2003 the Dabel Brothers entered into a written agreement that provided:
• That Devil’s Due will have the right to publish Dabel Brothers’ licensed titles, including Hedge Knight, Dragonlance and all other licensed properties through December 31, 2007;
• That Devil’s Due would not only publish the books created by DBPro under license, but also assist in the funding for such books, paying a significant percentage of the creative fees.
Devil’s Due has advanced substantial funds to Dabel Brothers for the payment of artists and authors who have contributed to the creation of a number of titles including Hedge Knight, Dragonlance and others currently being prepared for publication, and put substantial time and effort into publishing and marketing the books. While no new relationship is easy at the outset, Devil’s Due Publishing Inc. and DBPro. worked together to provide an interesting selection of high quality licensed books.
Within the last month DBPro stated that it was interested in altering the legal and binding contract between Devil’s Due Publishing Inc. and DBPro. Unable to reach an agreement regarding renegotiated terms, Devil’s Due Publishing Inc. informed DBPro that it would not agree to alter the original contract. DBPro then chose to unilaterally issue a press release announcing the termination of the relationship between Devil’s Due Publishing Inc. and DBPro.
Devil’s Due Publishing, Inc. has previously informed Dabel Brothers that under the Agreement executed last October, Dabel Brothers does not have the legal right to unilaterally terminate the existing Contract. Devil’s Due has lived up to its obligations, and trusts that the parties will be able to resolve this unfortunate misunderstanding. In the interim all joint projects with Dabel Brothers will be will be put on hold, while Dabel Brothers projects already produced will continue to be sold.
