Diamond Comic Distributors Suing GameStop For Almost $3 Million?!?

According to BleedingCool.com, Diamond Comic Distributors who is one of the largest comic book store direct market distributors here in the US filled a lawsuit this week in the district court of Maryland against the video game retailer GameStop.

Diamond is a distributor for things like collectibles, action figures, statues and of course comic books, all of which are things you can often find these days being sold in Gamestop stores. According to BleedingCool, Diamond is suing for a total of $2.8 million for items that it claims Gamestop ordered but then tried to cancel orders on.

It states that GameStop first opened an account with Diamond in 1997, when it was known as Babbage, before changing its name to GameStop in 2006, And that business dealings were fine until April 2022, when they claim Gamestop attempted "to cancel certain accepted purchase orders that were not yet fulfilled (i.e. delivered). This included a list of 87 previously submitted and accepted purchase orders, with a total contract price of in excess of $950,000.00."

Diamond claims that they told GameStop that "the products at issue were already ordered and paid for by Diamond (or that Diamond had partially paid for and was obligated to pay the full price for those goods). Diamond reminded Gamestop that pursuant to the agreement(s) and/or decades long course of dealings between the parties, accepted orders were not subject to cancellation without consent from Diamond. Gamestop nonetheless confirmed that it did not intend to accept or pay for the products."


Both Diamond and Gamestop have suffered setbacks in recent years. Back in 2020 Gamestop reportedly had to close 400-450 Stores with more closures likely to come. Diamond in the last few years lost the rights to be the exclusive distributor for three major comic book companies including Marvel, DC and IDW. At this time GameStop has yet to respond to Diamond's lawsuit.

I really hope this does not effect Gamestops here in Canada, and I hope this doesn't cause any issues that might involve Gamestop's closing (in Canada), Gamestop is the best Collectible retailer we have in Canada, I think almost everyone would be pretty devastated if we lost Gamestops.

Honestly as far as I'm concerned, screw them both. The large majority of Diamond's collectibles are overpriced crap, and that's assuming they actually ever get released. And GameStop has been screwing over its customers for years. Bring back Toys R Us and get rid of both of them.

Interesting, I didn't know that Diamond was no longer on the exclusive distributor for DC and Marvel books. The GameStop news really doesn't surprise me, wonder if this could be a problem that could mean the imminent end for GameStop.
